{"id":1072,"date":"2015-02-18T13:51:05","date_gmt":"2015-02-18T13:51:05","guid":{"rendered":"http:\/\/www.hpervinkarasu.av.tr\/?p=1072"},"modified":"2015-02-18T13:51:05","modified_gmt":"2015-02-18T13:51:05","slug":"is-hukuku-nedir","status":"publish","type":"post","link":"http:\/\/www.hpervinkarasu.av.tr\/?p=1072","title":{"rendered":"\u0130\u015f hukuku nedir"},"content":{"rendered":"<p>\u0130\u015f hukuku, i\u015f ili\u015fkisi i\u00e7inde olan ki\u015filerin uyulmas\u0131 zorunlu kurallar b\u00fct\u00fcn\u00fcd\u00fcr. \u0130\u015f hukuku resmi bir i\u015f yerinde hizmet akdi ile ba\u015flayan ve \u00e7al\u0131\u015fmas\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret alan i\u015f\u00e7i ile i\u015fveren aras\u0131nda ve bunlar\u0131n ba\u011fl\u0131 oldu\u011fu topluluklarla (SSK, \u0130\u015f ve \u0130\u015f\u00e7i Bulma Kurumu, sendikalar, odalar, \u00c7al\u0131\u015fma Bakanl\u0131\u011f\u0131, vak\u0131flar, dernekler vb.) olan ili\u015fkileri d\u00fczenleyen uyulmas\u0131 zorunlu kurallar b\u00fct\u00fcn\u00fcd\u00fcr. \u00c7al\u0131\u015fanlar, niteli\u011fi itibariyle, ba\u011f\u0131ml\u0131 \u00e7al\u0131\u015fanlar ve ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015fanlar olarak ikiye ayr\u0131l\u0131r. \u0130\u015f hukuku ba\u011f\u0131ml\u0131 \u00e7al\u0131\u015fanlardan sadece i\u015f\u00e7iyi ele al\u0131r ve i\u015fverenle olan ili\u015fkisini d\u00fczenler. Ba\u011f\u0131ml\u0131 \u00e7al\u0131\u015fanlar grubunda yer alan memurlar idare hukukunun 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun kapsam\u0131na girer. \u0130\u015f hukuku, kapsam olarak bireysel i\u015f hukuku ve toplu i\u015f hukuku olarak ikiye ayr\u0131l\u0131r.<br \/>\nBireysel \u0130\u015f Hukuku: Genellikle k\u00fc\u00e7\u00fck i\u015fletmelerde hizmet akdi ile ba\u015flayan i\u015f\u00e7i ile i\u015fveren aras\u0131ndaki ili\u015fkileri d\u00fczenler. Konular\u0131 olarak \u00fccret, hizmet akdi, \u00e7al\u0131\u015fma ko\u015fullar\u0131, ek \u00fccretler ikramiye, komisyon, sosyal haklar, i\u015ften ayr\u0131lma, tazminat gibi konular\u0131 kapsar.<\/p>\n<p>Toplu \u0130\u015f Hukuku: Genellikle b\u00fcy\u00fck i\u015fletmelerde i\u015f\u00e7i, i\u015fveren taraf\u0131ndan topluluklar \u015feklinde temsil edildi\u011fi (sendika) i\u015f yerlerinde uygulan\u0131r. Sendika kurma, sendikaya \u00fcyelik toplu s\u00f6zle\u015fme, sendikan\u0131n feshedilmesi, sendikal haklar gibi konular\u0131 kapsar.<br \/>\n\u0130\u015f Hukukundan do\u011fan bor\u00e7lar ikiye ayr\u0131lmaktad\u0131r. Bunlar:<br \/>\n2. \u0130\u015fverenin Bor\u00e7lar\u0131:<br \/>\n2.1. \u00dccret \u00d6deme Bor\u00e7lar\u0131: \u0130\u015f\u00e7inin hizmet akdinde belirtilen \u00e7al\u0131\u015fmay\u0131 yapmas\u0131 sonucunda i\u015fverenin hizmet akdinde belirtilen \u00fccreti \u00f6deme borcudur. \u00d6denecek \u00fccret yabanc\u0131 para birimleriyle de\u011ferli k\u00e2\u011f\u0131tlar ile (\u00e7ek, senet, bono, tahvil v.b.) ve \u00fcretilen maldan \u00f6denemez. \u0130\u015f hukukuna g\u00f6reT\u00fcrk paras\u0131 \u00f6denmesi zorunludur. \u00dccret \u00f6dendi\u011fi resmi bir belge ile belgelendirilmelidir.<\/p>\n<p>2.2. \u0130\u015f\u00e7inin Kullanaca\u011f\u0131 Ara\u00e7 ve Gere\u00e7 Malzeme ve Donan\u0131m\u0131 Temin Etme Borcu: \u00dcretimle direkt ba\u011flant\u0131l\u0131 olan veya olamayan malzemelerin ihtiya\u00e7 miktar\u0131nca i\u015fveren taraf\u0131ndan temin edilmesi gerekmektedir. Ara\u00e7, gere\u00e7 ve donan\u0131m\u0131n bak\u0131m, onar\u0131m servis i\u015flemleri ve kullan\u0131m d\u0131\u015f\u0131 oldu\u011funda yenilenmesi i\u015fverenin sorumlulu\u011fudur.<\/p>\n<p>2.3. \u0130\u015f\u00e7iyi Koruma Borcu: \u00dcretim an\u0131nda ve sonras\u0131nda insan sa\u011fl\u0131\u011f\u0131n\u0131 tehdit eden problemlerin tespit edilerek gerekli \u00f6nlemlerin al\u0131nmas\u0131 sorumlulu\u011fudur. \u00dcretimi yava\u015flatsa bile \u00e7al\u0131\u015fma sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile tedbirlerin uygulanmas\u0131n\u0131 sa\u011flayarak kontrol etmelidir. \u0130\u015fyeri bulundu\u011fu \u00e7evreye kar\u015f\u0131da insan sa\u011fl\u0131\u011f\u0131 ve ekolojik denge a\u00e7\u0131s\u0131ndan hukuksal ve etik olarak b\u00fcy\u00fck sorumluluk ta\u015f\u0131r.<\/p>\n<p>2.4. E\u015fit Davranma Borcu: \u0130\u015fyeri d\u0131\u015f\u0131nda yak\u0131nl\u0131\u011f\u0131 ve ili\u015fkisi ne olursa olsun i\u015fyerinde bulundu\u011fu b\u00f6l\u00fcm\u00fcn olmas\u0131 gereken s\u0131n\u0131rlar\u0131 i\u00e7inde e\u015fit davranmak sorumlulu\u011fundad\u0131r. \u00d6d\u00fcllendirme ve cezaland\u0131rma i\u015fyeri y\u00f6netmeli\u011fi ve hizmet akdi h\u00fck\u00fcmlerine g\u00f6re olmal\u0131d\u0131r. Keyfi davran\u0131\u015flar \u00e7al\u0131\u015fma bar\u0131\u015f\u0131n\u0131 ve disiplinini olumsuz y\u00f6nde bozar.<\/p>\n<p>2.5. Do\u011fum \u0130zni Borcu: \u0130\u015f Yasas\u0131\u2019n\u0131n 74. maddesine g\u00f6re Kad\u0131n i\u015f\u00e7ilerin do\u011fum izni, do\u011fumdan 18 ve do\u011fumdan sonra 8 hafta olmak \u00fczere toplam 16 haftad\u0131r. \u00c7o\u011ful gebelik halinde do\u011fumdan \u00f6nce \u00e7al\u0131\u015ft\u0131r\u0131lmayacak 8 haftal\u0131k s\u00fcreye 2 hafta daha eklenir. Sigortal\u0131 kad\u0131na veya sigortal\u0131 olmayan kar\u0131s\u0131n\u0131n do\u011fum yapmas\u0131 nedeniyle sigortal\u0131 erke\u011fe, \u00e7ocu\u011fun ya\u015famas\u0131 \u015fart\u0131yla do\u011fumdan sonraki 6 ay s\u00fcresince her ay, do\u011fum tarihinde ge\u00e7erli asgari \u00fccretin \u00fc\u00e7te biri tutar\u0131nda emzirme yard\u0131m\u0131 verilecektir. \u0130\u015f\u00e7inin istemesi ve sa\u011fl\u0131k durumunun uygun oldu\u011funun hekim raporu ile belgelenmesi durumunda do\u011fumdan \u00f6nceki 3 haftaya kadar i\u015fyerinde \u00e7al\u0131\u015fabilir. Bu durumda, kad\u0131n i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 bu s\u00fcre do\u011fum sonras\u0131 s\u00fcrelere eklenir.<br \/>\n2.6. \u0130\u015fverenin Oda ve Yurt A\u00e7ma Borcu: Ya\u015f\u0131na ve medeni durumuna bak\u0131lmaks\u0131z\u0131n 100 ile 150 aras\u0131 kad\u0131n i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015fyerlerinde bir ya\u015f\u0131ndan k\u00fc\u00e7\u00fck \u00e7ocuklar\u0131n bak\u0131lmas\u0131, b\u0131rak\u0131lmas\u0131 ve emziren i\u015f\u00e7ilerin \u00e7ocuklar\u0131n\u0131 emzirmeleri i\u00e7in i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015fma yerinden ayr\u0131 ve i\u015fyerine en \u00e7ok iki y\u00fcz elli metre uzakl\u0131kta bir emzirme odas\u0131 kurulmas\u0131 zorunludur. Ya\u015f\u0131na ve medeni durumuna bak\u0131lmaks\u0131z\u0131n 150\u2019den \u00e7ok kad\u0131n i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015fyerlerinde s\u0131f\u0131r alt\u0131 ya\u015f\u0131ndaki \u00e7ocuklar\u0131n bak\u0131lmas\u0131, b\u0131rak\u0131lmas\u0131 ve emziren i\u015f\u00e7ilerin \u00e7ocuklar\u0131n\u0131 emzirmeleri i\u00e7in i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015fma yerinden ayr\u0131 ve i\u015fyerine yak\u0131n bir yurt ve anaokulu kurulmas\u0131 zorunludur. Yurdun uzakl\u0131\u011f\u0131 iki y\u00fcz elli metreden uzakta ise i\u015fveren \u00fccretsiz ta\u015f\u0131t sa\u011flamak zorundad\u0131r. Oda ve yurt a\u00e7ma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnde i\u015fverenin belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde bulunan t\u00fcm i\u015fyerlerindeki kad\u0131n i\u015f\u00e7ilerin say\u0131s\u0131 dikkate al\u0131n\u0131r.<br \/>\n3. \u0130\u015f\u00e7inin Bor\u00e7lar\u0131:<br \/>\n3.1. \u00c7al\u0131\u015fma Borcu:<br \/>\nKendisinin \u00c7al\u0131\u015fma Borcu: Hizmet akdinde ismi ge\u00e7en i\u015f\u00e7inin \u00e7al\u0131\u015fmay\u0131 yapmas\u0131 sorumlulu\u011fudur. Yapaca\u011f\u0131 i\u015fi bir ba\u015fkas\u0131na i\u015fverenden habersiz devredemez. Devretmesi i\u015f hukukuna g\u00f6re hizmet akdinin bitirilmesine sebeptir. Hastal\u0131k, kaza sil\u00e2halt\u0131na al\u0131nma, k\u0131sa s\u00fcreli tutuklanma, \u00e7al\u0131\u015famama gibi durumlarda i\u015f\u00e7inin yerine bir ba\u015fkas\u0131n\u0131 bulma sorumlulu\u011fu i\u015fverene aittir. Hizmet akdi ile yap\u0131lacak i\u015f miras yoluyla varislerine devredilemez. Varisleri \u00e7al\u0131\u015fmay\u0131 devam ettirecek ise yeni hizmet akdinin yap\u0131lmas\u0131 gerekir. Hizmet akdi i\u015fverenin ki\u015fili\u011fine, kabiliyetine, becerisine dikkat ederek tercih etti\u011fi o i\u015fe uygun g\u00f6rd\u00fc\u011f\u00fc ki\u015fi ile yap\u0131ld\u0131\u011f\u0131 i\u00e7in bir ba\u015fkas\u0131na devredilece\u011fi d\u00fc\u015f\u00fcn\u00fclemez.<br \/>\nBelirtilen \u0130\u015fte \u00c7al\u0131\u015fma Borcu: \u0130\u015f\u00e7inin \u00e7al\u0131\u015faca\u011f\u0131 mesleki alan belirtilmemi\u015f ise (vas\u0131fs\u0131z i\u015f\u00e7i) i\u015fverenin takdir etti\u011fi alanda \u00e7al\u0131\u015fmak sorumlulu\u011fudur. Hizmet akdinin \u00e7al\u0131\u015faca\u011f\u0131 alan belirtilmi\u015f ise bu alanda \u00e7al\u0131\u015fma sorumlulu\u011fudur. Belirtilen alan\u0131n d\u0131\u015f\u0131nda \u00e7al\u0131\u015fmas\u0131 i\u015fveren ve i\u015f\u00e7inin r\u0131zas\u0131 ile olur.<br \/>\n\u0130\u015fin \u00d6zenle Yap\u0131lmas\u0131 Borcu: \u0130\u015fyerinin kalite ve kapasite ko\u015fullar\u0131na g\u00f6re \u00e7al\u0131\u015fma sorumlulu\u011fudur. \u00dcretimin d\u00fczeyini ve niteli\u011fini d\u00fc\u015f\u00fcrecek \u00e7al\u0131\u015fma temposunu yava\u015flatacak \u00e7al\u0131\u015fma bi\u00e7imi yasal ve etik a\u00e7\u0131dan do\u011fru de\u011fildir. \u0130\u015fyerinin ba\u015far\u0131s\u0131 i\u00e7in \u00fczerine d\u00fc\u015fen sorumlulu\u011fu yerine getirmelidir.<br \/>\n3.2. Sadakat Borcu: \u0130\u015fyeri ile ilgili gizlilik arz eden bilgi, teknoloji ve becerilerin de\u015fifre edilmemesi gerekir. \u00d6zellikle g\u00fcn\u00fcm\u00fczde rekabet ko\u015fullar\u0131nda gizlilik arz eden unsurlar\u0131n s\u0131zd\u0131r\u0131lmas\u0131 yasal h\u00fck\u00fcmlerle de s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r. Hizmet akdi sona erdi\u011finde gizlilik arz eden unsurlar\u0131 kullanabilir veya rakip firmalara aktarabilir.<br \/>\n3.3. \u0130\u015fyeri Kurallar\u0131na Uyma Borcu: \u0130\u015fyeri d\u0131\u015f\u0131nda yak\u0131nl\u0131\u011f\u0131 ve diyalo\u011fu ne olursa olsun i\u015fyeri ortam\u0131nda i\u015fyeri kurallar\u0131 ve ahlak \u00f6l\u00e7\u00fcleri i\u00e7inde hareket etmelidir. Problemli ve ge\u00e7imsiz \u00e7al\u0131\u015fma \u015fekli mesleki birikimi ne olursa olsun i\u015f yeri d\u00fczen ve ahenk i\u00e7inde istenmeyen unsurdur.
